Definition
RD 1215/1997 regulates the safe use of equipment already in service in Spain. Regulation (EU) 2023/1230 regulates conformity for placing machinery on the EU market. They are not the same. One looks at use on site. The other looks at the product and placing it on the market.

If I have CE marking, do I already comply with RD 1215?
Not necessarily. CE marking evidences conformity for placing on the market at a given time; RD 1215 requires keeping the equipment safe in its real use on site over time.
Does Regulation 2023/1230 replace RD 1215?
No. They are different frameworks. The Regulation mainly affects product conformity; RD 1215 affects the use of work equipment in Spain.
What happens if I modify an existing machine?
